What Evidence Matters?

Legal contributor Attorney Brian Mickelsen, an experienced truck accident lawyer, represents victims injured or killed in semi-truck accidents. Below, Attorney Mickelsen shared his insight into the legal options available to victims injured in commercial truck accidents.

Dash Cam Video

Witness statements and contact information

Photographs from the scene

Electronic black box data from all vehicles involved

Vehicle inspections

Hours of service logs

Toxicology reports

Attorney Mickelsen adds, “Based on the news articles, it is difficult to say who was the at-fault driver. In these situations, not only is it imperative to preserve the evidence mentioned above, but an attorney must also contact the responding officer as soon as possible to get the full picture. An attorney should send a letter of preservations of evidence to the trucking company so that material evidence is not lost, overwritten, or otherwise destroyed. And an attorney should retain an experienced accident reconstructionist to an expert to immediately analyze the scene.”
